John Doe indictments are routinely issued by federal grand juries to toll (extend) the statute of limitations for important crimes where the perpetrator has not yet been identified or found.

377 -- with the specific information in the indictment (age, height, hair color), does it still cover someone who does not meet that description?  For example, Rackstraw was in his late 20s, not mid 40s.  Is he covered by it?

Courts have generally proven VERY lenient with regard to errors or lack of specificity in John Doe warrants IF the real perp is later located. If there is enough info to put the criminal on notice that he is being prosecuted, that's all it takes.

The latest controversy is whether a DNA warrant will suffice. You are not allowed to view links. Register or Login

Last I looked these were ok in some state courts but not in federal courts.

377 -- with the specific information in the indictment (age, height, hair color), does it still cover someone who does not meet that description?  For example, Rackstraw was in his late 20s, not mid 40s.  Is he covered by it?

I believe the indictment has to have the best identifying information available at time of indictment but doesn't limit the prosecution of the right person

New Suspect

Cooper World welcomes a new suspect today: Olin Crandall Wilkinson, put forward today by a reader at the Mountain News-WA named Jim Davis.

I'm in the process of checking it out. Preliminary data says that Wilkinson was a Navy rigger, worked at the Pt. Mugu Naval Air Facility in 1966, and boasted of hijacking an airplane one day. He is also a "dead ringer" for DBC.

Any other info or further developments on Mr. Wilkinson?

Here is a question for any legal beagles out there. Count 1 of the indictment charges a violation under 49 USC 1472 (i) Aircraft piracy (codified in the 1970 edition of the US Code) which reads in part:

"(1) Whoever commits or attempts to commit aircraft piracy, as herein defined, shall be punished-
(A) by death if the verdict of the jury shall so recommend, or, in the case of a plea of guilty, or a plea of not guilty where the defendant has waived a trial by jury, if the court in its discretion shall so order; or
(B) by imprisonment for not less than twenty years, if the death penalty is not imposed."

At some point (I didn’t bother to research when) this was amended to 49 USC 46502 Aircraft piracy (codified in the 2006 edition, supplement 5 of the US Code) which reads in part:

"(2) An individual committing or attempting or conspiring to commit aircraft piracy—
(A) shall be imprisoned for at least 20 years; or
(B) notwithstanding section 3559(b) of title 18, if the death of another individual results from the commission or attempt, shall be put to death or imprisoned for life."

I would expect the law in effect at the time of the offense would control at sentencing, however in this case the the law has been amended to a lessor penalty. Would that have any effect?

No I don't. But they it is in the FBI's file 1 starting at page 12 (by count).

No I don't. But they it is in the FBI's file 1 starting at page 12 (by count).

Um - no... That indictment on the FBI Vault page is for a fraud case, where someone claimed to be Cooper to sell a story. The actual John Doe indictment is not shown in the FBI FOIA reading room (as it is an "open case").

One would have to talk to the folks in the Federal Court system (Oregon district) to get the correct one.
